📜 Indian Labour Reform

4 New Labour Codes

The Government of India consolidated 29 central labour laws into 4 comprehensive Codes to modernize compliance, standardize wage definitions and extend social security coverage.

🇮🇳 Reform Overview

The 4 Labour Codes — enacted between 2019 and 2020 — replace 29 legacy central acts. Once fully notified by all states, they will bring uniformity in wage definitions, social security, working conditions and industrial relations across all Indian states and union territories.

💰
1. Code on Wages, 2019
Replaces: Minimum Wages Act 1948 · Payment of Wages Act 1936 · Equal Remuneration Act 1976 · Payment of Bonus Act 1965
Uniform Wage Definition: Basic + DA + Retaining Allowance must be at least 50% of total gross salary.
National Floor Wage: Central Government sets a floor wage below which no state minimum wage can be fixed.
2-Day Settlement Rule: Full & final wages must be paid within 2 working days of resignation or termination.
Gender Parity: Equal remuneration for same or similar nature of work — regardless of gender.
Overtime Rate: Overtime work must be compensated at 2× the ordinary rate of wages.
🛡️
2. Code on Social Security, 2020
Replaces: EPF Act 1952 · ESI Act 1948 · Gratuity Act 1972 · Maternity Benefit Act 1961 · Employees’ Compensation Act 1923
Gig & Platform Workers: First time inclusion of gig/platform/unorganized workers in social security schemes.
1-Year Gratuity Eligibility: Fixed-term employees eligible for pro-rata gratuity after just 1 year (reduced from 5).
EPF: Mandatory for establishments with 20+ workers — 12% contribution each from employer and employee.
ESI: Medical cover mandatory for 10+ worker establishments where wages ≤ ₹21,000/month.
Maternity Benefit: 26 weeks of paid maternity leave for eligible female employees.
🏭
3. Occupational Safety, Health & Working Conditions Code, 2020
Replaces: Factories Act 1948 · Contract Labour Act 1970 · Mines Act 1952 · BOCW Act 1996 — and 10 others
Working Hours Cap: Maximum 8 hours/day and 48 hours/week across all commercial and industrial establishments.
Appointment Letter: All employers must issue formal written appointment letters to every employee.
Annual Health Checkup: Free health screening for workers aged 45 and above, at employer’s cost.
Single Registration: One national electronic registration covers multiple establishments, reducing compliance burden.
🤝
4. Industrial Relations Code, 2020
Replaces: Industrial Disputes Act 1947 · Trade Unions Act 1926 · Industrial Employment (Standing Orders) Act 1946
300-Worker Threshold: Prior government approval required for retrenchment, layoff or closure in establishments with 300+ workers (raised from 100).
14-Day Strike Notice: Mandatory 14-day advance notice required before any industrial strike or lockout.
Grievance Redressal: Mandatory GRC committee in all establishments with 20+ workers, with female representation.
Negotiating Union: Introduces concept of a single negotiating union representing the majority of workers.
